"One of the Best Defense Lawyers"

I have practiced law in Sioux City for 36 years, about the same length of time as Scott. He is primarily an insurance defense lawyer and I am a plaintiff’s lawyer, so we are always adverse to one another. Scott is one of the best defense lawyers I have litigated against. "5 Stars Aren't Enough"

I was fortunate enough to meet Nick Wingert. He was honest, hardworking and very professional. I was very pleased and impressed and would recommend him to anyone in need. His prices were more than reasonable. For the last year that I have been in the court room for a divorce and custody case, he has been on my side and a true blessing. "Vast Knowledge and Resources"

I contacted Nick via phone, he handled probably one of the toughest divorce cases in history. Nick with his vast knowledge and resources was able to earn the judges trust by using the laws of Iowa and outcomes from Iowa case history to successfully have the judge reverse his previous decision without the need for appeals court. Nick handled the whole case for me and never once left me uncertain of possible outcomes. He was very straight forward and gave me options for consideration but always had the knowledge to make the right decisions. Nick handled this case without ever meeting in person and was able to make the process flawless doing everything via email even though we were 1000 miles apart. $805,000 Work Injury Settlement

April 22, 2024 Sioux City — A worker injured in a 2018 methane gas explosion at Sioux City’s Citizen’s Convenience Center has reached an $805,000 settlement of a lawsuit filed against the city and three companies.

Douglas Mallette claimed the parties in the suit failed to properly monitor the buildup of the combustible gas inside the Convenience Center’s office and scale house. The gas ignited and caused an explosion when a worker lit a hand-held lighter on Dec. 27, 2018. Mallette and another worker were injured.

Mallette and his wife, Sandra, of South Sioux City, filed suit in November 2020 in Woodbury County District Court, saying the city was negligent in securing competent services to detect, monitor, remediate and warn of methane gas inside the center’s scale room or failed to follow a consultant’s advice on how to do so.

Also named in the suit were Aerionics Inc., doing business as Macurco Gas Detection, of Sioux Falls, which manufactured and sold gas detectors installed at the site; Metro Electric Inc., of Sioux City, which installed two of the detectors at the center; and Barker Lemar and Associates, a West Des Moines engineering consulting firm contracted by the city to monitor the methane levels and periodically inspect the gas monitors.

Located at the city’s former landfill at 5800 28th St., the Convenience Center, which is managed by Gill Hauling of Jackson, Nebraska, accepts items such as grass clippings, tires, furniture, and appliances that are not picked up curbside by garbage trucks or are too large to fit inside residential garbage containers. It is also a collection point for household hazardous materials.

According to terms of the settlement, which was approved March 25 by the Sioux City Council, the Mallettes will receive $40,000 from Macurco, $165,000 from Metro Electric and $200,000 from Barker Lemar. The remaining $400,000 assigned to the city was paid by Gill Hauling. Under terms of a defense and indemnification agreement in Gill Hauling’s contract with the city to manage the center, Gill Hauling accepts defense and liability for claims filed against the city concerning the center.

The settlement is not an admission of liability, according to terms of the agreement.

Mallette’s attorney, Scott Hindman, of Sioux City, said Mallette has lasting effects from his injuries.
